The agreement for using blkboxuas.com and the BLKBOX app: what BLKBOX does, what stays your responsibility as an operator, who owns the records, and the legal fine print. Written plainly, so you can read it before you sign in.

01The agreement

BLKBOX UAS is operated by BLKBRD CO LLC, doing business as BLKBOX UAS, based in Tennessee, USA ("BLKBOX", "we", "us"). These terms cover the website at blkboxuas.com and the BLKBOX app at app.blkboxuas.com, including the Operator Passport and Project Record pages operators share from the app.

By signing in to the app, or by using the site or the app, you agree to these terms and to how we handle information as described in our Privacy Policy. If you don't agree, don't use BLKBOX.

If you set up or run an operator (a company or other organization) in BLKBOX, you agree to these terms on its behalf and confirm you have the authority to do so. "You" then means both you and that operator.

You must be at least 18, or the age of majority where you live, to use the app.

02The beta

The app is in an invite-only beta. During the beta:

  • Access is by invitation, and we decide who is invited.
  • Features may be added, changed or removed, sometimes without notice, and things may not always work as described.
  • There is no guaranteed uptime or response time. We fix what we can as fast as we can.
  • Nothing is charged (section 09).

Your feedback helps us build BLKBOX. If you send us ideas or suggestions, we may use them without owing you anything for them.

03What BLKBOX is, and isn't

BLKBOX is a record-keeping and compliance-tracking tool for UAS operators. It stores the records you give it, works out dates and currency from them, reads public data such as FAA airspace charts, and flags what looks due, missing or out of date.

BLKBOX does not fly your aircraft or clear your flight. It does not issue certificates, insurance, waivers or airspace authorizations, and it is not a LAANC provider. A CLEARED status means nothing in the record you filed blocks the mission; it is not permission to fly.

You and your remote pilot in command remain fully responsible for every flight, including complying with 14 CFR Part 107 and every other law, regulation, airspace restriction, waiver condition, client requirement and insurance condition that applies. Before each flight, check LAANC or other authorizations, NOTAMs, TFRs, weather and the aircraft yourself, using official sources.

BLKBOX's results are only as good as the information behind them. Records you enter may be incomplete or wrong, and public data (FAA airspace and facility maps, elevation data, the Blue UAS list) may be outdated, delayed or wrong. Airspace shown in BLKBOX is a chart read at the moment it was taken, not a briefing.

04Accounts and crew

You sign in with your Google account. Keep that account secure, because anyone who can sign in to it can sign in to BLKBOX as you. Sign out of devices you no longer use (My account shows every device you're signed in on), and tell us right away if you think someone has used your account without permission.

An operator's owner controls the operator's account: who is invited, each person's role, and the operator's records. Owners are responsible for the people they invite and for what their crew does in BLKBOX.

An owner may add crew who don't sign in themselves. When you do, you confirm the person has agreed to have their details and documents kept in BLKBOX, and you keep that record accurate for them.

05Your records

You own your records. Everything you or your crew file in BLKBOX (profiles, certificates, documents, fleet, clients, projects, missions, flight logs and links) stays yours or your operator's.

You give us permission to store, copy, process and display your records, and to share them in the ways you choose, only as needed to run BLKBOX for you, keep it secure, and improve it. We don't sell your records or use them for advertising. Personal information is handled as described in the Privacy Policy.

You confirm that you have the right to upload what you file, including other people's information and certificates and your clients' documents, and that it is accurate to the best of your knowledge. Keep it current: an expired policy or a lapsed certificate that was never updated in BLKBOX can't be flagged correctly.

We keep your records available for as long as your operator's account is open. We take care to protect them (see the Privacy Policy), but keep your own copies of anything you can't afford to lose. Project Records can be saved as PDF and their flights downloaded as CSV at any time.

An Operator Passport or Project Record link works without a sign-in. Anyone who has the link can see what is on that page and download the documents you chose to show there, until you withdraw the link.

You decide what goes on each link and who you send it to. Once someone has downloaded a document, we can't take it back, and we aren't responsible for what recipients do with it. Withdraw a link from the app as soon as it shouldn't work any more.

07Acceptable use

Don't use BLKBOX to:

  • Break any law or regulation, or help someone else do so.
  • File false, forged or altered certificates, insurance documents, authorizations or records, or present a record to a client as something it isn't.
  • Upload anything you don't have the right to share, or that contains malware.
  • Access accounts, records or operators that aren't yours, or try to get around sign-in, roles or other security.
  • Probe, scan, scrape, overload or disrupt the service, or reverse engineer it except where the law allows.
  • Resell or sublicense access to BLKBOX, or use it to build a competing product.

We may remove content or limit access where we reasonably believe these terms are being broken.

08Other services

BLKBOX relies on other services, including Google (sign-in and maps), ID.me (optional military verification), Cloudflare (hosting and storage) and public data from the FAA and the U.S. Geological Survey. Using those parts of BLKBOX may also be subject to those providers' own terms. We don't control those services and aren't responsible for their availability, accuracy or actions.

BLKBOX's software, design, name and logo belong to us. These terms give you the right to use BLKBOX; they don't give you any ownership of it.

09Fees

BLKBOX is free during the beta. When paid plans start, we'll tell you the price and the date billing begins before you're charged anything, and you decide whether to continue. Paid plans will be billed as shown on our pricing page at the time you subscribe, together with any additional terms shown when you sign up for a plan.

10Ending your use

You can stop using BLKBOX at any time. An owner can ask us to close the operator's account; any member can ask us to delete their own account. Before closing, save the Project Records and flight logs you want to keep.

We may suspend or end your access if you break these terms, if your use puts other users, BLKBOX or the public at risk, or if the law requires it. We may also end the beta or discontinue BLKBOX. Except where we have to act immediately, we'll give you reasonable notice and a chance to save your records first.

When an account closes, shared links stop working and records are deleted as described in the Privacy Policy. Sections 05 (the permission we need to finish deleting your records), 07, and 11 to 15 continue to apply after your use ends.

11Disclaimers

BLKBOX is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or that BLKBOX will be uninterrupted, secure or error-free. We don't warrant that any status, date, airspace read, currency calculation or check shown in BLKBOX is correct or complete, or that it meets any regulatory requirement.

12Limitation of liability

To the fullest extent the law allows, BLKBOX and its owners, employees and agents won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, jobs, data or goodwill, arising from or related to BLKBOX or these terms, even if we were told they were possible.

We aren't liable for any accident, injury, property damage, fine, penalty, certificate action or enforcement action arising from your flight operations, including where you relied on information in BLKBOX.

Our total liability for all claims arising from or related to BLKBOX or these terms is limited to the greater of the amount you paid us for BLKBOX in the 12 months before the claim arose, or US $100.

Some places don't allow these exclusions or limits, so some of them may not apply to you. Nothing in these terms limits liability that can't be limited by law.

13Indemnity

You agree to defend and hold harmless BLKBOX and its owners, employees and agents from claims, damages and costs (including reasonable legal fees) brought by others that arise from your flight operations, from records or documents you or your crew file or share, or from your breach of these terms or of the law.

14Changes to these terms

We may update these terms as BLKBOX grows. We'll change the revision date at the top, and for changes that materially affect you we'll tell you by email or in the app before they take effect. If you keep using BLKBOX after a change takes effect, the new terms apply. If you don't agree with a change, stop using BLKBOX and ask us to close your account.

15Governing law

These terms are governed by the laws of the State of Tennessee and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute that isn't resolved informally will be heard in the state or federal courts located in Tennessee, and you and we consent to those courts' jurisdiction. Before filing a claim, please contact us so we can try to resolve it directly.

If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given up the right to enforce it later. You can't transfer these terms without our consent; we may transfer them as part of a reorganization, merger or sale of BLKBOX. These terms, the Privacy Policy and any terms shown when you sign up for a paid plan are the whole agreement between you and us about BLKBOX.
